The present General Conditions of Sale govern the relations between the Company PLACE DES TENDANCES, simplified joint stock company with a capital of ¿750,000, whose headquarters is at 98 Rue de Provence - 75008 Paris, France, listed in the Nanterre Trade and Companies Register under number 493 264 527 (hereinafter "PLACE DES TENDANCES") and customers wishing to make a purchase on the site www.placedestendances.com (hereinafter "the customer")
Any order implies full acceptance of these General Conditions of Sale.
Orders will only be processed when payment has been accepted.
PLACE DES TENDANCES undertakes to honour orders received where stocks are available, and when items are out of stock, to inform the customer of this by any means available; the customer may then cancel their order and be reimbursed, if applicable, for sums already paid.
PLACE DES TENDANCES reserves the right to cancel or refuse any order from a customer with whom a dispute is ongoing relative to payment for a previous order.
Delivery methods:Products will be sent out within 24 hours for any order placed Monday to Friday before 2pm (orders placed after 2pm are prioritised for delivery the next working day) to the delivery address indicated when the order was placed, provided that it is in mainland France (including Corsica), Belgium, Luxembourg, Italy, Austria, Ireland, Netherlands, Portugal, Slovakia, Slovenia or Spain.
Date of delivery:PLACE DES TENDANCES undertakes to deliver to the customer within the timescales indicated prior to confirmation of the order and subject to payment.
If the item has been shipped prior to receipt of the order cancellation on account of a delivery delay of more than seven days, PLACE DES TENDANCES will reimburse the cost of the item and the costs of delivery and return, on receipt of the complete item, in its original condition and with all labels still attached.
Any non-conforming parcel or parcel open when delivered to the customer must be subject to a written reservation on receipt/collection and customer services must be notified of this the same day.
PLACE DES TENDANCES undertakes to inform the customer of the progress of their order.
The prices indicated are expressed in euro and include all taxes excluding shipping costs, which are payable by the customer. Any change in the statutory rate of VAT applicable will be automatically reflected in the prices of the items when such change comes into force.
Flat-rate shipping costs are charged once per order and can be combined for several orders placed during the same sale and paid for in one carte bleue bank transaction.
For some items, customers may be required to pay additional shipping costs over and above standard, with this amount being specified in the sale terms.
Full payment must be made at the time of ordering. Sums paid may not under any circumstances be considered prepayments or deposits.
Customers can pay for their orders by bank card, PayPal or in three instalments at no extra cost.
For a bank card transaction, the customer should quote the number on the front of their card, the expiry date and the security code on the back of the card (last three digits). It will then be possible to store the bank card details if desired. These are encrypted on your computer and then transmitted in an unintelligible format to our partner servers which alone can decipher them. Each time a saved card is used, the user has to enter their account password.
The fact that a customer provides their bank card number authorises PLACE DES TENDANCES to debit their account for the order amount.
No cash on delivery will be accepted for any reason.
PLACE DES TENDANCES shall retain ownership of the item until the customer has made payment in full.
Purchases are made in a secure manner. The payment solutions adopted by PLACE DES TENDANCES are 100% secure. For payments by bank card (carte bleue, carte bleue visa and e-carte bleue), Crédit Mutuel's CYBERMUT system is responsible for ensuring the security of payments.
PLACE DES TENDANCES also accepts payment via PAYPAL which allows account holders to pay online using this method.
These solutions protect the information that customers provide to PLACE DES TENDANCES and ensure the conformity and security of each transaction.
Furthermore, in order to combat fraud, PLACE DES TENDANCES has set up a system that implements exclusion lists, which may result in it:
(I) requesting certain supporting documents once payment has been made in order to secure the transaction, where an automatic alert has been triggered by the information relating to the order.
(II) blocking an order if the customer account has already been used to commit fraud.
TAll the texts, comments, photos, trademarks, illustrations and images reproduced on the site www.placedestendances.com are protected by intellectual property and for the whole world. Any total or partial reproduction of the site www.placedestendances.com is strictly prohibited.
The essential characteristics of the items are presented on www.placedestendances.com in each of the item description sheets. The customer is fully informed that the images, photos and colours of the items for sale could however be different from the actual colours due to the effect of the Internet browser and the screen used.
Any dissatisfied customer has a period of 15 days from the date of shipment to return the item and obtain reimbursement of sums already paid. This period includes the legal seven-day cooling off period provided for in articles L121-20 and following of the French Consumer Code.
The item should be returned in as-new condition, in its original packaging and accompanied by a returns form available from the "My account" section of www.placedestendances.com; the parcel should be sent to the address shown on this returns form.
In the absence of a returns form, Place des Tendances will be unable to reimburse payment for returned items.
Returned items that are damaged, incomplete, used or soiled will not be taken back if they are not in a resalable condition. Returned "creams" and "make-up" must not have been opened, or even taken out of their packaging.
Customers will be reimbursed for returned items within a maximum period of 15 days from receipt by Place des Tendances.
Reimbursement amounts will be credited to the customer's bank or PAYPAL account. In case of partial or full payment by voucher, this part of the sum will necessarily be refunded in the form of a voucher. Parcels, sent or return, reported lost by the carrier will be reimburse by credit note.
The customer will not be eligible for the "satisfied or your money back" guarantee and may not call on the legal seven-day cooling off period for items made to customer specifications or specifically personalised.
Items are returned at the risk and cost of the customer.
Returns from abroad (outside of France) are made via DHL International. The return address is located in Germany; your parcel is then redirected to our warehouse and the return time is two to three weeks.

PLACE DES TENDANCES is responsible for product conformance faults on ordering and for hidden defects subject to the conditions set out in articles 1641 and 1649 of the French Civil Code.In accordance with the provisions of order no. 2005-136 of 17 February 2005, the articles of the Civil Code mentioned above and the articles of the Consumer Code related to consumer goods guarantees are reproduced within the present General Conditions of Sale.
During visits to www.placedestendances.com, PLACE DES TENDANCES may ask its customers for information through the use of questionnaires and forms, and particularly when creating a customer account.
This information is intended for data processing at PLACE DES TENDANCES, for the purposes of logging and processing orders, managing customer accounts, running marketing surveys and compiling statistics in order to provide customers with the most appropriate offers, and ensure high-quality monitoring of its services and sales canvassing.
PLACE DES TENDANCES will send its commercial offers to customers by email.
In accordance with the law of 6 January 1978, customers have a right of access to their personal data that they may exercise by writing to the Customer Relations Department, and this without prejudice to the right which they also have to oppose the above conditions for the use of their personal data for the purposes of commercial solicitations by PLACE DES TENDANCES alone or in partnership with other companies.
When their account is created, customers will be able to choose whether to receive commercial offers sent by the trading partners of PLACE DES TENDANCES.
The present general conditions of sale are subject to French law. In case of dispute, exclusive jurisdiction is attributed to the competent French courts, notwithstanding plurality of defendants and/or the introduction of third parties even for urgent or preventive measures, by application for summary proceedings or by petition.
The seller is required to deliver a product which conforms to the contract and is held liable for any lack of conformity existing upon delivery. The seller is also held liable for any lack of conformity caused by the packaging or the assembly instructions, or the installation if the seller assumed responsibility therefor or had it carried out under his responsibility.
To conform to the contract, the product must:
1. Be suitable for the purpose usually associated with such a product and, if applicable:
- Correspond to the description given by the seller and have the features that the seller presented to the buyer in the form of a sample or model;
- Have the features that a buyer might reasonably expect it to have considering the public statements made by the seller, the producer or his representative, including advertising and labelling; or
2. Have the features defined by mutual agreement between the parties or be suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to.
Action resulting from lack of conformity lapses two years after delivery of the product.
A seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have paid a reduced price for it, had he known of them.
The action resulting from the defects giving rise to the right to cancellation must be brought by the buyer within a period of two years following the discovery of such defect.
